By accessing or using GPT Rewind ("Service," "we," "our," or "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

GPT Rewind is a ChatGPT analytics platform that provides:

• AI personality type analysis
• Trending topics identification
• IQ level assessment based on ChatGPT usage
• Conversation insights and growth tracking
• Performance analysis and streak tracking
• Shareable social media cards

The Service requires users to upload their ChatGPT conversation export files for analysis.

3. Account Registration

3.1 Account Creation

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Eligibility

You must be at least 13 years old to use this Service. By using GPT Rewind, you represent that you meet this age requirement.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Pricing and Payment

4.1 Pricing Tiers

GPT Rewind offers the following one-time payment tiers:

• Explorer Plan: $2.99 for 1 analysis token
• Deep Insight: $7.99 for 3 analysis tokens
• Cognitive Edge: $13.99 for 5 analysis tokens

A free preview is available to all users with limited features.

4.2 Payment Processing

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.

4.3 No Subscriptions

All purchases are one-time payments. There are no recurring charges or subscription fees.

4.4 Refund Policy

Due to the digital nature of our service and immediate delivery of analysis results:

• Refunds are generally not available after analysis completion
• Refunds may be considered for technical failures preventing service delivery
• Refund requests must be submitted within 7 days of purchase

4.5 Price Changes

We reserve the right to modify pricing at any time. Changes will not affect purchases already completed.

5. User Content and Data

5.1 Your ChatGPT Data

When you upload your ChatGPT conversation export:

• You retain all rights to your original conversation data
• You grant us a limited license to process and analyze this data
• Your uploaded files are automatically deleted within 24 hours
• We retain only the computed insights and analytics, not raw conversations

5.2 Prohibited Content

You may not upload content that:

• Contains malware, viruses, or malicious code
• Infringes on intellectual property rights
• Contains illegal content or promotes illegal activities
• Violates any third-party rights
• Attempts to exploit or harm minors

5.3 Data Accuracy

While we strive for accuracy, AI-generated insights are for entertainment and informational purposes. We do not guarantee the accuracy, completeness, or reliability of any analysis results.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the Service
• Use automated scripts, bots, or scrapers without permission
• Overload or interfere with the Service's infrastructure
• Impersonate others or misrepresent your affiliation
• Collect or harvest data from other users
• Transmit spam, advertising, or promotional materials

7. Intellectual Property

7.1 Our Rights

The Service, including its design, code, algorithms, graphics, and content, is owned by GPT Rewind and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials without permission.

7.2 Your Rights

You retain ownership of:

• Your original ChatGPT conversation data
• Your analysis results and insights
• Your shareable social media cards

7.3 Trademark

"GPT Rewind" and associated logos are trademarks. You may not use our trademarks without prior written consent.

8. Disclaimers and Limitations

8.1 "As Is" Service

8.2 No Professional Advice

GPT Rewind provides entertainment and informational insights only. Our analysis does not constitute:

• Professional psychological assessment
• IQ testing for official purposes
• Career counseling or advice
• Medical or therapeutic guidance

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GPT REWIND SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Service interruptions or technical failures
• Third-party actions or content

Our total liability shall not exceed the amount you paid for the Service in the past 12 months.

9. Indemnification

You agree to indemnify and hold harmless GPT Rewind, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Third-Party Services

Our Service integrates with third-party providers:

• Clerk: Authentication services
• Stripe: Payment processing
• Supabase: Database services
• Vercel: Hosting infrastructure

These services have their own terms and privacy policies. We are not responsible for third-party services or content.

11. Termination

We may terminate or suspend your account immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent activity
• Compromise service security
• Abuse or harass other users or staff

You may terminate your account at any time through your account settings. Upon termination:

• Your right to use the Service ceases immediately
• Your data may be deleted after a reasonable period
• Unused analysis tokens are forfeited

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. All disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

12.2 Dispute Resolution

In accordance with Dutch law, any disputes shall be resolved through:

1. Good faith negotiation between parties
2. Mediation in accordance with the Netherlands Mediation Institute (NMI) rules
3. Legal proceedings before the competent Dutch courts if mediation fails

12.3 European Consumer Rights

If you are a consumer resident in the European Union, you benefit from mandatory consumer protection provisions under EU law and the laws of your country of residence. Nothing in these Terms affects your rights as a consumer.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Significant changes will be communicated via email or prominent notice on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Data Processing Agreement, constitute the entire agreement between you and GPT Rewind.

14.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

14.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.
